LEGAL NOTICE: GENERAL TERMS AND CONDITIONS

APPLICABLE LEGISLATION
This electronic contract is concluded in compliance with Spanish legislation and specifically under the legal regime imposed by Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE) and by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users (TRLDCU). The electronic contract is presented to the consumer in Spanish. These General Conditions of Contract may be saved and reproduced at any time by the user (hereinafter, the User or the Client, indistinctly) who makes a purchase through the options of their internet browser, and must be accepted before proceeding to the payment of the products. Likewise, we will include a link to these General Terms and Conditions of Contract in the email confirming the purchase that we send you.
GEOGRAPHICAL AREA
Velarte will ship only and exclusively in the provinces of: Valencia, Castellón and Alicante.
PURCHASING PROCESS
To make a purchase on www.velarte.com/en the User must follow the following process:
- Select the products you wish to purchase from among those offered by VELARTE on its website.
- Select the product you wish to buy and click on the ‘Buy’ button. If you wish, you can add as many products as you want to the shopping cart. The purchase limit is 16 kilos of volumetric weight.
- Once you have completed your product selection, you will be able to access your shopping cart where you will see a summary identifying the item(s) you have selected.
- To complete your purchase, you will have to include your identification and delivery details. Subsequently, the means of payment will be selected. At this stage, the buyer expressly declares that he/she is the owner of the means of payment (the use of a third party’s means of payment, even with authorisation, is not permitted).
- Once the order process has been completed, VELARTE will send you an email detailing the details of your order. If you do not receive this email within twenty-four (24) hours, please contact us.
- If you notice any errors in the data entered in your order, you can correct them by sending an e-mail to contacto@velarte.com.
From this moment, the process of preparation and delivery of the products sold by VELARTE begins. VELARTE will proceed to deliver the product to the address indicated in the purchase process.
- The delivery of the products can be made: at the address indicated in the purchase process, or it can also be picked up at the factory of Productos Velarte S.L. located at Polígono Industrial el Bony Calle 42 s/n, 46.470 – Catarroja (Valencia). The collection period will be 4 days from the date of purchase. The collection timetable is from Monday to Friday from 9:00 to 14:00 and from 15:30 to 17:00 (except holidays).
- The User may only enter into a contract if he/she is of legal age and/or has the legal capacity to enter into a contract. Otherwise, the responsibility for orders placed by minors shall be borne by the parents or legal guardians of the minor.
PAYMENT METHODS
VELARTE has the following payment method to facilitate your purchases:
- Credit card
Payment by credit/debit card used in VELARTE implies that your card information will be sent directly to our payment partner Banco Sabadell. This entity has access to the customer’s identification data and details of the purchase made related to the payment process.
Through this payment method, VELARTE never collects or manipulates any customer data relating to their card number. All data is processed directly by Banco Sabadell, so that VELARTE can always offer the greatest transparency and confidentiality in the transaction. The payment of your order is made directly with this bank, thus offering you maximum security.
The cards currently supported by the payment gateway are all Visa and Mastercard cards.

TAXES
- The P.V.P. (retail price) of the articles includes 10% V.A.T. for food items. Transport includes 21% VAT.
RETURNS
At VELARTE we want our customers to always be satisfied with our service. Therefore, we provide several methods to return a product that may not meet your needs.
Possible cases of return or withdrawal:
- The product has a defect or has been damaged during transport:
To start the procedure, you must contact the VELARTE Customer Service Department by sending an e-mail to contacto@velarte.com.
These products must be returned by the Client in such a way that they are protected, including them in a protective box or bag. VELARTE will bear all shipping costs for the delivery and return of the product.
VELARTE offers you our transport company to collect the goods, completely free of charge. If you wish to return the goods with a transport company other than the one proposed by VELARTE and the transport company selected by the Client offers higher rates, the Client will assume the difference in transport costs.
If the product has been damaged during transport, we need to be notified within 24 hours of receipt of the goods, unless the damage is obvious, in which case the claim must be made at the time of delivery.
Likewise, in order to speed up the return process, we would be grateful if you could send us photographs of the damaged item and its packaging, where the damage can be seen, as well as the barcode of the item and the labelling of the damaged box.
- Withdrawal
In accordance with the provisions of Spanish law, the Customer has the Right of Withdrawal, by virtue of which he/she may return the product received if he/she finds that it does not meet his/her expectations.
To initiate the procedure, you must contact VELARTE by sending an email to contacto@velarte.com and express your wish to withdraw from the purchase. Please note that the exercise of this right of withdrawal must be made within a maximum period of fourteen (14) calendar days from receipt. In order to exercise this right, the product must be in perfect condition.
In the event of withdrawal, VELARTE will refund all payments received by the user, including delivery costs (with the exception of the additional costs resulting from the user’s choice of a delivery method other than the least expensive ordinary delivery method that we offer). The refund of the purchase price will be made once the condition of the goods has been checked, through the same means of payment used by the Customer and, in any case, within a maximum of 14 calendar days from the reliable receipt of the cancellation request, provided that it is VELARTE who manages the collection of the item. In the event that the Customer returns the item via a transport company of their choice, the period of fourteen (14) days will begin to run from the time VELARTE has actual knowledge of the dispatch of the goods or, failing that, from the receipt of the item.
The cost of returning the goods in order to exercise the right of withdrawal (including VAT) shall be borne by the Customer.
In the event that the products do not arrive in perfect condition for reasons attributable to the Customer, VELARTE reserves the right to pay a lower amount for your order based on the depreciation of the value of the product.
- If any of the products do not correspond to the order placed.
In this case, we will send you the correct products again or refund you the corresponding amount. We will pay for any transport costs that may arise, provided that the product has not been used, altered or tampered with. You must contact us within 3 days via contacto@velarte.com. After this period we reserve the right to accept the return for this reason.
- Upon receipt of the product
You can only cancel your order or make changes if your order is not already in the PREPARATION phase. If it is already in the PREPARATION phase, the delivery process is irreversible. In this case, you may refuse delivery, and the Customer will be responsible for the return transport costs (VAT included).
The company will not accept any exchange or return of products without prior authorisation from the company. To do so, you must contact us by email at contacto@velarte.com, where we will indicate the steps to follow to successfully complete the return.
GUARANTEES
For food products, from the date on which you receive your product, a period of 3 months before the expiry date is guaranteed. In the exceptional case where the expiry date of the product is less than one month, this circumstance will be expressly indicated on the product description sheet.
To start the process, please send an email to contacto@velarte.com indicating the reason ‘Warranty’. We will inform you of the rebate/replacement process.
In the absence of proof to the contrary, the goods shall be deemed to be in conformity with the contract provided that they meet all the requirements set out below:
- Conform to the description given by the seller and possess the qualities of the product which the seller has presented to the Customer.
- Are fit for the purposes for which products of the same type are normally intended.
- Are of such quality and performance as is customary for a product of the same type as the Customer may reasonably expect, taking into account the nature of the product.
PROTECTION OF PERSONAL DATA
Users can visit this website without providing any personal data; however, there are various options for registration, queries or order forms where personal data is collected and processed. You can consult the information on how we treat your personal data by accessing our Privacy Policy.
RECIPIENTS OF DATA AND INTERNATIONAL TRANSFERS
In this legal notice we inform the User that the processing of information collected through this website does not involve international transfer of data. In relation to the recipients of the information, we inform you that in the event that you make an online purchase that must be delivered to the address you indicate, the package sent will include your name and surname, delivery address and telephone number.
In accordance with the above, in this legal notice we inform you that we will share your personal data with the following types of service providers for VELARTE:
Service providers: These are companies external to VELARTE that provide them with a service so that it can carry out its activity and fulfil its commitments to its clients.
In this regard, the main service providers to whom the data may be communicated are transport companies, couriers, in order to facilitate the delivery process.
Payment gateways and banks: Payment of purchases by credit card in VELARTE implies that your card information will be sent directly to our payment partner Banco Sabadell.
